2. Website Use

The information on this website is provided for general informational and marketing purposes. You agree to use this website only for lawful purposes and in a way that does not interfere with the website, our business, or other users.

You may not attempt to gain unauthorized access to our website, servers, systems, accounts, or data.

3. Service Agreements

The exact scope of work for client projects may be established through a proposal, invoice, email, written agreement, or other communication between Zion Marketing Solutions and the client.

When project-specific terms conflict with these general Terms and Conditions, the terms of the applicable written service agreement or proposal will generally control for that project.

Additional work outside the agreed scope may require additional fees.

4. Payments

Clients are responsible for paying all fees according to the payment terms provided in their proposal, invoice, or service agreement.

Depending on the service, Zion Marketing Solutions may require a deposit, advance payment, recurring monthly payment, or payment in full before work begins or is delivered.

Third-party expenses, including advertising spend, domain registrations, hosting, premium software, plugins, stock assets, or other outside services, may be billed separately unless specifically included in the agreed price.

5. Cancellations and Refunds

Cancellation and refund terms may vary depending on the service purchased and the individual agreement.

Because many of our services involve professional time, strategy, research, design, content creation, setup, and other work performed specifically for a client, payments for completed work are generally non-refundable.

Deposits may also be non-refundable once work has begun.

Any specific cancellation policy contained in a signed agreement, proposal, or other written arrangement will take precedence.

6. Website Design and Development

Clients are responsible for providing requested information, content, images, login credentials, approvals, and other materials necessary to complete their website.

Project timelines may be affected if requested materials, feedback, or approvals are delayed.

Unless otherwise agreed, substantial revisions, new pages, additional functionality, or work requested outside the original project scope may result in additional charges.

7. SEO, Google Maps, and AI Visibility

Digital visibility is influenced by many factors outside the control of Zion Marketing Solutions.

We do not guarantee specific search engine rankings, Google Maps positions, website traffic levels, leads, sales, revenue, or placement within answers generated by artificial intelligence platforms.

Search engines, AI platforms, social networks, directories, and other third-party services may change their algorithms, policies, ranking systems, features, or availability at any time.

Our goal is to improve a client’s digital presence using strategies and practices we believe can strengthen visibility and performance, but specific results cannot be guaranteed.

8. Google Business Profile and Third-Party Platforms

Some services may involve Google Business Profile, Google Maps, social media platforms, advertising networks, AI platforms, directories, or other third-party services.

These platforms operate independently from Zion Marketing Solutions. We are not responsible for platform outages, suspensions, verification requirements, policy changes, account restrictions, algorithm updates, lost rankings, rejected content, or other actions taken by third-party providers.

Clients remain responsible for complying with the policies and terms of any third-party platforms they use.

9. Advertising

Advertising performance can vary based on competition, budget, audience, industry, geographic market, creative materials, landing pages, platform algorithms, and other factors.

Zion Marketing Solutions does not guarantee a specific number of impressions, clicks, leads, customers, conversions, or sales from advertising campaigns unless expressly stated in a written agreement.

Advertising spend paid directly to platforms may be separate from our management fees.

10. Client Responsibilities

Clients agree to provide accurate information and to have the necessary rights or authorization to use any content, photographs, logos, trademarks, videos, customer information, or other materials supplied to Zion Marketing Solutions.

The client is responsible for reviewing and approving final materials and confirming the accuracy of business information, claims, pricing, legal disclosures, and other published content.

11. Intellectual Property

Unless otherwise agreed in writing, Zion Marketing Solutions retains ownership of its proprietary processes, strategies, templates, methods, internal tools, and other pre-existing intellectual property.

Upon full payment, clients may receive ownership or usage rights to final project deliverables as specified in their agreement.

Third-party assets, software, fonts, plugins, themes, photographs, or other licensed materials remain subject to the terms of their respective owners and licenses.

12. Portfolio and Promotional Use

Unless otherwise agreed in writing, Zion Marketing Solutions may display completed work, including websites, logos, graphics, marketing materials, and publicly available project information, in our portfolio, website, social media accounts, proposals, case studies, and other promotional materials.

Confidential client information will not knowingly be disclosed for promotional purposes.

13. Confidentiality

We will make reasonable efforts to protect confidential business information provided to us in connection with a project.

Clients are also responsible for protecting passwords, account credentials, and other sensitive information associated with their websites and third-party accounts.

14. Accuracy of Information

We make reasonable efforts to provide accurate information through our website, audits, reports, recommendations, and marketing materials. However, digital information can change quickly.

Search rankings, reviews, business listings, competitor information, AI-generated results, advertising data, and third-party platform information may change after they are reviewed or reported.

Information provided through an audit, analysis, or report represents conditions observed at or around the time the research was performed.

15. No Guarantee of Results

Marketing involves numerous variables, including competition, market conditions, customer behavior, budgets, platform changes, and decisions made by the client.

Past performance, examples, case studies, projections, estimates, audits, or recommendations should not be interpreted as guarantees of future results.

16. Limitation of Liability

To the fullest extent permitted by law, Zion Marketing Solutions will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from the use of our website or services.

This includes losses related to search rankings, website downtime, third-party platforms, advertising performance, lost leads, lost revenue, data loss, account restrictions, or changes made by search engines, AI platforms, social networks, or other third parties.

19. Changes to These Terms

Zion Marketing Solutions may update these Terms and Conditions periodically to reflect changes in our services, business practices, technology, or legal requirements.

Changes will become effective when the updated Terms and Conditions are published on this website unless otherwise stated.

20. Governing Law

Any dispute relating to these terms or our services will be handled in accordance with applicable Texas and United States law.
